With the SCOTUS’s decision in JDB v North Carolina in 2011, the court introduced the idea of the reasonable juvenile as a substitute for the reasonable person in Miranda custody determinations. There are many other areas of the criminal law where the reasonable person plays a role in culpability, or where reasonableness is part of the calculus in measuring conduct. The webcast will introduce the concept of the reasonable juvenile as articulated in JDB and then offer examples of lawyers can use this construct in both juvenile and criminal cases.
